Terms of Service
Last updated: 27 August 2026
These terms govern your use of RankMeasure, a service operated by Nestake LLC, a Delaware limited liability company with its registered address at 16192 Coastal Highway, Lewes, DE 19958, USA (“we”, “us”). They are written to be read: each section says what it means in plain language. By buying a Benchmark, subscribing to Monitor, or using a report we deliver, you accept these terms.
1. Accepting these terms
You are bound by these terms when you place an order, pay for a service, or access a delivered report. If you buy on behalf of a business, you confirm you are authorised to bind that business, and “you” in these terms means that business.
If you do not agree with these terms, do not purchase or use the service.
2. What the words mean
“Snapshot” is the free, short preview measurement for a business. “Benchmark” is the one-time full report: 22 prompts across 4 AI engines, a visibility score, competitor share, citations and priority actions. “Monitor” is the recurring monthly measurement subscription. “Report” means any Snapshot, Benchmark or Monitor output we deliver.
“AI engine” means a publicly available AI assistant (such as a chat-based assistant) whose answers we sample for measurement.
3. The service
RankMeasure measures and reports what AI assistants say about businesses in a given market. We send a defined set of prompts to AI engines, record the answers, and turn them into scores, comparisons and recommendations. The service is provided by Nestake LLC operating as RankMeasure.
A Benchmark includes: sampling of 22 prompts across 4 AI engines, a visibility score with a confidence band, competitor share comparison, the cited sources behind AI answers, and 5 prioritised actions. Monitor repeats the measurement on a monthly cycle so you can track change over time.
The service has no user accounts. Reports are delivered electronically — by link and/or email — to the address you provide at purchase. The sample report on our website is illustrative and does not describe a real business.
4. Reports are informational measurements
AI assistants do not give the same answer every time. Our scores are sampled measurements at a point in time, with a stated confidence band — they describe what we observed, within a known margin, not an absolute truth.
We give no guarantee of business outcomes (more customers, more revenue) and no guarantee of how any AI engine will behave in the future. AI engines change their models, sources and behaviour without notice, and that is outside our control.
Reports are decision-support information. They are not legal advice, not financial advice, and not a substitute for your own judgement about your marketing.
5. Purchases, prices and delivery
Benchmark: a one-time fee of £149, paid via Stripe. We deliver the report within 72 hours of successful payment. If we fail to deliver within 72 hours, you are entitled to a full refund on request — see our Refund Policy.
Monitor: £99 per month, billed recurring via Stripe. Each payment covers one monthly measurement cycle. You can cancel at any time; cancellation takes effect at the end of the current paid cycle, and you keep access until then. There are no partial-month refunds.
Benchmark credit: if you subscribe to Monitor within 7 days of your Benchmark being delivered, 50% of the Benchmark fee (£74.50) is credited against your first Monitor month. Example: you pay £149 for a Benchmark on Monday, subscribe on Friday — your first Monitor month costs £24.50 instead of £99.
Prices are in British pounds and include any taxes we are required to charge; where a tax such as VAT applies, it is shown at checkout by Stripe. You authorise us to charge the payment method you provide for the recurring Monitor fee until you cancel.
6. Acceptable use
Reports are provided for the purchasing business and its internal use. You may share a report with your own team, contractors and advisers.
You may not resell reports or access to them, present a report as measuring a business other than the one purchased for, or use automated tools to scrape or bulk-access report pages.
7. Intellectual property
You receive a non-exclusive, non-transferable licence to use your delivered reports for your own business purposes, indefinitely.
We retain all rights in the RankMeasure service, the measurement methodology, scoring models, prompt sets and the website. Nothing in these terms transfers those rights to you.
8. Disclaimers
The service is provided “as is” and “as available”. Beyond what these terms expressly state, we exclude all warranties to the maximum extent the law allows — including implied warranties of merchantability and fitness for a particular purpose.
We do not warrant that AI engines will remain available, answer consistently, or that third-party AI platforms will not change in ways that affect measurements.
9. Limitation of liability
To the maximum extent permitted by law, our total liability to you for all claims relating to the service is capped at the fees you paid us in the 3 months preceding the event giving rise to the claim (or, for a one-time Benchmark, the Benchmark fee).
We are not liable for indirect or consequential damages: lost profits, lost revenue, lost customers, loss of data, or business interruption — even if we were told they were possible.
Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, such as liability for death or personal injury caused by negligence, or for fraud.
10. Governing law and disputes
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules.
Before starting any formal proceeding, contact us at support@rankmeasure.com so we can try to resolve the dispute informally. Courts in Delaware have jurisdiction over disputes that cannot be resolved informally, except where mandatory consumer law gives you the right to sue in your own courts.
11. Changes to these terms
We may update these terms from time to time. The current version is always on this page. Material changes — for example to prices, delivery commitments or liability — are notified to active customers by email before they take effect.
If you continue a Monitor subscription after a notified change takes effect, you accept the updated terms. If you do not accept them, you can cancel before the change applies.
12. General
If any part of these terms is found unenforceable, the rest stays in force. Our failure to enforce a right once is not a waiver of that right. You may not transfer your rights under these terms without our consent; we may transfer ours in connection with a merger or sale of the business.
These terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and us about the service.
